Except in the case where the original owner had language in the contract to
the affect that warranties are not transferable to third parties. Though
perhaps not common, it does exist in our industry. We learned the hard way on this
issue. From that learning experience, I always look for language addressing
this issue in ANY purchase contract I'm considering signing. If I don't like
what it says, I ask that it be changed. If it's not specifically addressed, I
would not allow it to remain that way. Without it being clear in the
contract the door to litigation may be too easy to open.
