OK…you are on the right track:  The status of the alpaca should have been ascertained before she was sold if there was any question of being exposed to the tainted feed.  Magical has been very up front about it---so why did the sellers not have this information.
 
The payments on the animal are at least ½ of the asking---which did not take into consideration the status of the animal's health exposures.
 
That would be an affirmative allegation---which you bring up in counter suit. 
 
Let's hope that a letter from your attorney---worth the hour of time it costs----will bring this matter to a negotiated end.
 
I am a RETIRED attorney---and I don't practice law any more---but your basic instincts are not wrong.  I did not get to your query today because my Mom passed away this morning---and while, at 97 this was not unexpected---it is never easy.  In any case---I'm not at my best, but your thread seems to be on the right track.

Amy,
I curious about how much money (approximately) we are talking about? If you don't want to say the amount or want to email me privately, or just say that it's none of my business,.............that's ok.

I'm just curious as it would seem to me that for him to take legal action, hire an attorney, etc............he could end up out more money that he could possibly get. Then again, I don't know a whole lot about the cost of attorneys & legal action costs, etc. But I would think it would be in his best interest to work with you rather than against you.
